A national survey on researchers’ experiences with their institutional review boards (IRBs) is presented, focused exclusively on social and behavioral researchers. A wide range of experiences is apparent in the data, especially in terms of turnaround time for submitted protocols, incidence of data collection without prior IRB approval, and stated reasons for "going solo." Sixty-two percent felt that the turnaround time they typically experience is "reasonable," and 44% said they had not experienced long delays in obtaining approval. However, 48% of (...) respondents reported either conducting a project without IRB approval or modifying an existing project without IRB approval, with anticipated time for approval being the dominant reason offered for doing so. This adds a new dimension to the widely discussed "national IRB crisis" (e.g., Illinois White Paper, 2005). The article concludes with 2 preliminary recommendations for IRB reform. (shrink)

In May 1973 a new collaboration between NASA, the Indian Health Service, and the Lockheed Missiles and Space Company promised to transform the way members of the Papago (now Tohono O’odham) Tribe of southern Arizona accessed modern medicine. Through a system of state-of-the-art microwave relays, slow-scan television links, and Mobile Health Units, the residents of the third-largest American Indian reservation began to access physicians remotely via telemedical encounters instead of traveling to distant hospitals. Examining the history of the STARPAHC (Space (...) Technology Applied to Rural Papago Advanced Health Care) project from the perspective of NASA and its contractors, from the perspective of the Indian Health Service, and from the perspective of O’odham engineers and health professionals offers a new focus, emphasizing the American Indian reservation as a site of medical research and technological development in the late twentieth century, with specific attention to the promise of information technology to address health disparities and the role of American Indians as actors in the late twentieth-century history of science, technology, and medicine. We investigate the higher-order modal logic , which is a variant of the system presented in our previous work. A semantics for that system, founded on the theory of quasi sets, is outlined. We show how such a semantics, motivated by the very intuitive base of Schrödinger logics, provides an alternative way to formalize some intensional concepts and features which have been used in recent discussions on the logical foundations of quantum mechanics; for example, that some terms like 'electron' have (...) no precise reference and that 'identical' particles cannot be named unambiguously. Schrödinger logics are logical systems in which the principle of identity is not true in general. The intuitive motivation for these logics is both Erwin Schrödinger's thesis (which has been advanced by other authors) that identity lacks sense for elementary particles of modern physics, and the way which physicists deal with this concept; normally, they understandidentity as meaningindistinguishability (agreemment with respect to attributes). Observing that these concepts are equivalent in classical logic and mathematics, which underly the usual physical theories, we (...) present a higher-order logical system in which these concepts are systematically separated. A classical semantics for the system is presented and some philosophical related questions are mentioned. One of the main characteristics of our system is that Leibniz' Principle of the Identity of Indiscernibles cannot be derived. This fact is in accordance with some authors who maintain that quantum mechanics violates this principle. Furthermore, our system may be viewed as a way of making sense some of Schrödinger's logical intuitions about the nature of elementary particles. (shrink)

In this first paper of a series of works on the foundations of science, we examine the significance of logical and mathematical frameworks used in foundational studies. In particular, we emphasize the distinction between the order of a language and the order of a structure to prevent confusing models of scientific theories with first-order structures, and which are studied in standard model theory. All of us are, of course, bound to make abuses of language even in putatively precise contexts. This (...) is not a problem—in fact, it is part of scientific and philosophical practice. But it is important to be sensitive to the dierent uses that structure, model, and language have. In this paper, we examine these topics in the context of classical logic; only in the last section we touch upon briefly on non-classical ones. (shrink)

In this paper we make some general remarks on the use of non-classical logics, in particular paraconsistent logic, in the foundational analysis of physical theories. As a case-study, we present a reconstruction of P.\ -D.\ F\'evrier's 'logic of complementarity' as a strict three-valued logic and also a paraconsistent version of it. At the end, we sketch our own approach to complementarity, which is based on a paraconsistent logic termed 'paraclassical logic'.

In this work, the first of a series, we study the nature of informal inconsistency in physics, focusing mainly on the foundations of quantum theory, and appealing to the concept of quasi-truth. We defend a pluralistic view of the philosophy of science, grounded on the existence of inconsistencies and on quasi-truth. Here, we treat only the ‘classical aspects’ of the subject, leaving for a forthcoming paper the ‘non-classical’ part.

En este artículo argumentamos que la naturaleza pública o privada de la educación tiene una incidencia directa en las instituciones que conforman la realidad social. Para sustentar lo anterior, en primer lugar discutimos cómo, según Searle, habitamos un mundo de instituciones gobernadas por reglas y poderes deónticos, ontológicamente irreductibles. Luego, postulamos que la intencionalidad colectiva requiere de la confianza para mantenerse, y esta aumenta cuando gobiernan reglas y poderes deónticos en circunstancias normales. Sócrates es un ejemplo de esto, al proponer una filosofía que no solo busca la verdad, sino que además privilegia el reconocimiento de la ley por sobre la satisfacción inmediata de deseos e inclinaciones personales. De todo esto se explica el círculo virtuoso: la educación pública, al ser inclusiva y beneficiar a todos, potencia las instituciones sociales que tutelan ese interés y, dentro de ellas, el servicio público. In November of 1959, William Bean published in the Archives of Internal Medicine a scathing review of Félix Martí-Ibañez’s Centaur: Essays on the History of Medical Ideas. Martí-Ibañez and Bean were two of the leading exponents of the importance of medical humanism during a formative period from the 1950s through the 1970s. But the two physicians differed fundamentally in their views of the ideal relationships among the pharmaceutical industry, the medical profession, and the medical humanities. There is evidence that problem-based learning (PBL) is an effective approach to teach team and problem-solving skills, but also to acquire content knowledge. However, there is hardly any literature about using PBL in philosophy classes. One problem is that PBL is resource intensive because a facilitator is needed for each group of students to support learning efforts and monitor group dynamics. In order to establish more PBL classes, the question is whether PBL can be provided without the need for facilitators. (...) We present a combination of five strategies—among them the collaborative argument visualization software AGORA-net—to replace facilitators. Additionally, we present evidence that these strategies are sufficient to provide a PBL experience that achieves intended learning goals in an ethics class and is satisfying for students without facilitators. This paper is the sequel of a previous one where we have introduced a paraconsistent logic termed paraclassical logic to deal with 'complementary propositions'. Here, we enlarge upon the discussion by considering certain 'meaning principles', which sanction either some restrictions of 'classical' procedures or the utilization of certain 'classical' incompatible schemes in the domain of the physical theories. Here, the term 'classical' refers to classical physics. The current two-sample investigation explores the role of enactment as a boundary condition in the relationship between experienced incivility and workplace outcomes. We integrate the tenets of the transactional model of stress and sensemaking theory to explain why enactment is a psychological sensemaking capability that can neutralize the adverse effects of experienced incivility on workplace outcomes. The results across two samples of data supported the study hypotheses by demonstrating that experienced incivility had stronger adverse effects on employees’ job satisfaction, OCBs, (...) and turnover intent for employees who reported lower levels of enactment than employees who reported higher levels of enactment. This study’s results make three important contributions to theory and research. First, we make an empirical contribution by examining enactment as a psychological sensemaking capability that can neutralize the adverse effects of experienced incivility on workplace outcomes. Second, we make a theoretical contribution by integrating the tenets of the transactional model of stress and sensemaking theory in a novel way that explains why enactment is a psychological sensemaking capability that can neutralize the adverse effects of stress on strain. Third, we demonstrate that enactment is the boundary condition that explains why incivility does not have universally adverse effects on employees’ outcomes. (shrink)

In this basically expository paper we discuss the role oflogic and mathematics in researches concerning the ontology of scientific theories, and we consider the particular case of quantum mechanics. We argue that systems of logic in general, and classical logic in particular, may contribute substantially with the ontology of any theory that has this logic in its base. In the case of quantum mechanics, however, from the point of view of philosophical discussions conceming identity and individuality, those contributions may not (...) be welcome for a specific interpretation, and an altemative system of logic perhaps could be used instead of a classical system. In this sense, we argue that the logic and ontology of a scientific theory may be seen as mutually inftuencing each other. On the one hand, logic contributes to shape the general features of the ontology of a theory; on the other hand, the theory also puts constraints on the possible understanding of ontology and, respectively, on possible systems of logic that may be the underlying logic ofthe theory. Author Jeremy Waldron has thoroughly revised thirteen of his most recent essays in order to offer a comprehensive critique of the idea of the judicial review of legislation. He argues that a belief in rights is not the same as a commitment to a Bill of Rights. This book presents legislation by a representative assembly as a form of law making which is especially apt for a society whose members disagree with one another about fundamental issues of principle.

Civilizational analysis has not concerned itself too greatly with the historical experiences of the American New World. There are good reasons to correct this position and Shmuel Eisenstadt’s principal work on America’s distinct modernities goes some way to establishing the colonization of the Atlantic world as an opening phase of modernity. Nonetheless, a more far-reaching analysis of the distinctiveness of diverse American societies can be developed that goes beyond the image of a Protestant North America contrasted with southern Latin cultures. This article outlines the basis for a more nuanced approach in three steps: a focus on intercivilizational engagement, examination of civilizational factors neglected by Eisenstadt and reconsideration of the conceptual range of the notion of ‘civilization’ itself. Scholars of modernity have taken a particular interest in processes of urbanization and—thinking of Simmel, Benjamin, Mumford and Weber—the character of different varieties of city. From a different angle, notions of urban imaginary have gained greater purchase in the field of contemporary urban studies in comparative analysis of varieties of city. This essay begins with notes on both classical accounts of the city in social theory and current concepts of urban imaginaries. The notes revolve around the essay’s main topic: the (...) institution of cities of New World, specifically those of the United States and Canada. Paralleling Castoriadis’ conception of the imaginary institution, the present author argues for a more exact notion of metropolitan imaginaries, differentiated from the broader subject of urban imaginaries. ‘Metropolitan imaginaries’ denotes processes of urbanization at the heart of networks of migration, transport, and flows of capital and culture. As part of larger imaginaries, metropolises generate immigrant cities. The specific kind of creation in question produces creativity also by concentrating intellectual and creative schools of design in architecture and visual culture. In sum, metropolises are not merely part of networks of connection and creation; they produce networks and act as the hubs of interaction and creativity within larger social imaginaries. The essay explores this argument in the contexts of US and Canadian modernity and state formation, with specific foci on New York, Chicago, and Toronto. The conclusion notes two limitations to the case presented here and sketches planned directions for future research. (shrink)

Proponents of the rule of law argue about whether that ideal should be conceived formalistically or in terms of substantive values. Formalistically, the rule of law is associated with principles like generality, clarity, prospectivity, consistency, etc. Substantively, it is associated with market values, with constitutional rights, and with freedom and human dignity. In this paper, I argue for a third layer of complexity: the procedural aspect of the rule of law; the aspects of rule-of-law requirements that have to do with (...) "natural Justice" or "procedural due process." These I believe have been neglected in the jurisprudential literature devoted specifically to the idea of the rule of law and they deserve much greater emphasis. Moreover procedural values go beyond elementary principles like the guarantee of an unbiased tribunal or the opportunity to present and confront evidence. They include the right to argue in a court about what the law is and what its bearing should be on one's situation. The provision that law makes for argument is necessarily unsettling, and so this emphasis on the procedural aspect highlights the point predictability should not be regarded as the be-all and end-all of the rule of law. Johann Arnason’s exploration of the historical constellation of East Asia has helped reproblematize the conceptual framework of modernity and civilization. This article outlines Arnason’s innovations in civilizational analysis and social theory in the field of comparative studies of Japan. It sets out the terms on which a nuanced elaboration of Arnason’s framework could occur. Two areas warrant closer attention: state formation and the institution of capitalism. It is argued that there are signs of what might be termed a ‘tertiary’ phase (...) of state formation, implicit in Arnason’s discussion of advanced modernity. Moreover, this phase brought Japan into close contact with the newly unfolding context of the West’s civilizational imaginary, particularly in its ideological expressions of evolutionism. The article ends on the problematic of capitalism, raising questions about further potential theoretical developments based on Arnason’s conclusions and other inventive studies of Japanese capitalism. Medical tourism is the practice of traveling across international borders with the intention of accessing medical care, paid for out-of-pocket. This practice has implications for preferential access to medical care for Canadians both through inbound and outbound medical tourism. In this paper, we identify four patterns of medical tourism with implications for preferential access to care by Canadians: Inbound medical tourism to Canada’s public hospitals; Inbound medical tourism to a First Nations reserve; Canadian patients opting to go abroad for medical (...) tourism; and Canadian patients traveling abroad with a Canadian surgeon. These patterns of medical tourism affect preferential access to health care by Canadians by circumventing domestic regulation of care, creating jurisdictional tensions over the provision of health care, and undermining solidarity with the Canadian health system. BackgroundCritical public health measures implemented to mitigate the spread of the novel coronavirus disease (COVID-19) pandemic have disrupted health research worldwide, including HIV prevention research. While general guidance has been issued for the responsible conduct of research in these challenging circumstances, the contours of the dueling COVID-19 and HIV/aids pandemics raise some critical ethical issues for HIV prevention research. In this paper, we use the recently updated HIV Prevention Trials Network (HPTN) Ethics Guidance Document (EGD) to situate and analyze key (...) ethical challenges related to the conduct of HIV prevention research during the COVID-19 pandemic as well as identify potential areas for refinement of the guidance document based on this unprecedented state of affairs.Main bodyNecessary actions taken for HIV prevention research studies due to the COVID-19 pandemic involve an array of ethical issues including those related to: (1) risk mitigation; (2) behavior change; (3) compounding vulnerability; (4) community engagement; (5) trial reopening; and 6) shifting research priorities.ConclusionsIn the context of the dueling HIV and COVID-19 global pandemics, research teams and sponsors must be nimble in responding to the rapidly changing environment by being sensitive to the associated ethical issues. The HTPN EGD provides a rich set of tools to help identify, analyze and address many of these issues. At the same time, future refinements of the HPTN EGD and other research ethics guidance could be strengthened by providing explicit advice regarding the ethical issues associated with disrupted research and the reopening of studies. In addition, additional consideration should be given to appropriately balancing domains of risk (e.g., physical versus social), addressing the vulnerability of research staff and community partners, and responding to un-anticipatable ancillary care needs of participants and communities. Appropriately addressing these issues will necessitate conceptual work, which would benefit from the careful documentation of the actual ethical issues encountered in research, the strategies implemented to overcome them, and their success in doing so. Throughout all of these efforts, it is critical to remember that the HIV pandemic not be forgotten in the rush to deal with the COVID-19 pandemic. (shrink)

This article builds on my previous article on Dirk H. Th. Vollenhoven (Ive 2015) and provides an overview of the development of the systematic philosophy of Herman Dooyeweerd. This article seeks to provide an overview of the key developments in the thinking of Dooyeweerd, both in the convergences arising from the conversation of the two brothers-in-law and long-term colleagues and in their divergences. Dooyeweerd and Vollenhoven worked within the tradition of Abraham Kuyper, the father of Reformational philosophy. The development of (...) their respective philosophical systematics has tended to be addressed separately. However, I argue that the close cooperation between the two philosophers was critical in the formulation of the philosophy of the cosmonomic Idea. The philosophical conversation between the two persisted, despite critical divergences, largely aired privately. Their respective insights remained a source of mutual stimulus and complementarity foundational for Reformational philosophy. (shrink)
